The myths which seek to assert the idea of completeness per medium of the creature of dual sex are legion. The androgyne of Plato, the Tiresias of the fable, through their double sexuality and their ability to meld in one body both animus and anima, the genius of man and the genius of woman, affirm the idea of ontological perfection. But, consubstantial with their radiant power is the terror that they generate. For they unsettle even the gods. Symbol of the (...) creative harmony and beauty of the universe, the androgyne is nonetheless the harbinger of catastrophe. Its perfection is an anomaly. Its beauty a provocation. Contrary to accepted ideas, questions of gender started to be raised around the end of the 19th century. The characters of problematic sex and sexuality who abounded in literature at that time had the function of emblems of the fears aroused by the erasure and divorce between the sexes in a civilization in disarray. The figure of the androgyne was used to name and depict those condemned to indecision. But its closeness to the invert led to the decline of the (...) myth, which in the meantime was taken over by turn-of-the-century clinical medicine. Just like homosexuality, hermaphroditism became an anomaly, and those affected by it were depicted as deviant, incomplete beings. However, it was from the explosive superimposition of those two denigrated figures – the homosexual and the androgyne – that the concept of gender emerged in its true nature, that is, as a mental construction as much as an anatomical destiny. This paper offers a reconstruction of Descartes’s theory of the emotions, with special focus on the virtue “générosité” which he proposed as the master virtue to help humans manage and control their desires so that they can achieve the highest level of happiness which transcends the unpredictability and arbitrariness of fate. It first provides an analysis of Descartes’s notion of “divine providence,” “vain desires,” and “regret ;” then proceeds to offer an investigation of “générosité” both as an emotion and as (...) a virtue ; and concludes with an examination of “générosité” as a tool to master and control the emotions. S’appuyant sur l’argument que la rencontre de la philosophie confucéenne avec la théorie éthique occidentale ne constitue pas un tournant, cet article cherche dans le vocabulaire de l’éthique confucéenne les éléments permettant de dessiner la vision sui generis de la vie morale comme une éthique de rôle confucéenne. Etant donné la centralité de la famille en tant que lieu initial d’acquisition des qualités morales, un terme clé du corpus confucéen qui exprime cette notion d’éthique de rôle n’est rien d’autre que (...) l’impératif moral primordial de cette tradition, à savoir la « révérence familiale » – ou pitié filiale – ( xiao ). Si notre but est d’aborder la tradition confucéenne selon ses propres termes et de la laisser s’exprimer par elle-même sans la remplacer par nos propres priorités culturelles, il faut commencer par reconsidérer de manière critique la conception confucéenne de l’individu comme point de départ de l’éthique confucéenne. Cette dernière diffère du tout au tout de l’individualisme qui fonde l’approche occidentale dont la terminologie est éloquente (agents, actions, traits de caractères, autonomie, choix, liberté, principes…). L’éthique confucéenne s’appuie d’abord sur une vision totalisante de l’expérience humaine et recourt à un ensemble de termes qui révèlent des idées totalement différentes : par exemple que les qualités morales se manifestent sous la forme d’une virtuosité consommée dans les rôles et les relations qui nous constituent. Ne pas distinguer les « êtres » humains individuels des « devenirs humains » relationnels revient bon gré mal gré à importer, avant même de se pencher sur la question, une notion contemporaine de personne résolument étrangère au sujet. L’utopie est nominalement un nulle part qui est aussi, comme nous le dit Thomas More, un “bon” endroit. Bien qu’il existe des notions concurrentes, la description grecque occupe une place importante dans la plupart des récits d’utopie. Les détails de cet idéal sont si précis que la littérature utopique consiste en un catalogue (et une critique) de ces caractéristiques. Cet essai attire l’attention sur le parfum attribué aux « Îles des bienheureux » de Lucien, ainsi que sur la description qu’en (...) fait Nietzsche, sur sa sensibilité à l’odorat et sur l’attention portée par Illich à l’« atmosphère » et au nez. On aborde également le scepticisme envers l’utopie et des parallèles sont établis, d’une part, avec les critiques pragmatiques de l’utopie comme étant intrinsèquement totalitaires, d’autre part, avec la « bonne vie » dans la théorie politique et le défaut programmatique de la fantaisie techno-utopique. L’article se concentre sur la pandémie de covid-19 dans une tentative d’évaluer la contribution éventuelle de l’analyse philosophique à la compréhension et à la résolution des problèmes éthiques, juridiques et sociopolitiques qu’elle soulève. On aborde une série de dilemmes cruciaux qui requièrent des décisions pratiques, avant et après la production et la disponibilité des vaccins, à la lumière des théories éthiques et politiques contemporaines. Il s’avère que dans la plupart des cas les conceptions déontologiques semblent l’emporter sur les considérations conséquentialistes, (...) qui ne s’imposent à notre raisonnement que dans des situations d’urgence immédiate. La pandémie nous permet également d’apprécier le rôle important des vertus éthiques et épistémiques dans la prise des décisions critiques. (shrink)

À partir des propos sur l’amitié amorcés par les philosophes confucianistes et grecs de l’antiquité, cet article s’intéressera aux points de vue de Xun zi sur le sujet en examinant où et comment il propose une justification morale de l’amitié. Nous montrerons que, tout en s’inscrivant dans le sillage de Confucius et de Mencius, il aborde de façon singulière l’amitié à travers sa propre conception de la nature humaine, de l’étude, et des formes et de la fonction de la communauté (...) humaine. On détaillera ensuite les trois arguments avancés par Xun zi : l’amité permet de surmonter nos tendances innées à la compétition et au conflit ; elle participe aussi de l’étude et de l’éducation, puisque les amis sont analogues à des maîtres en matière d’influence morale et de modèles à suivre ; enfin l’amitié aide les communautés humaines à fonctionner correctement. On en arrivera à la conclusion que cette triple approche constitue chez Xun zi la justification de l’amitié, qui ne diverge pas seulement des raisons avancées par la philosophie grecque mais se différencie plus ou moins des points de vue soutenus par Confucius et Mencius. The phenomenon of Public Interest Litigation [PIL] is a judicially crafted one and primarily consists of the constitutional court’s expansion of fundamental rights on the one hand, and procedural innovations to create better opportunities for disadvantaged groups to gain access to the legal system on the other. It has created a renewed conception of justice, and has enabled the court to augment and validate its own authority as the “guardian” of the public welfare, and as the constitutionally appointed branch of (...) the state to enforce the rights of the “public”. PIL at one level appears to have enabled the justice system and laws to define and shape social and political interactions and to channelize democratic pressures for gaining a response from the state. But it has also been a process by which law and justice emerge from social and political interaction. This new interaction between the realm of judicial decision making and state governance has created adjustments and adaptations and the creation of new legal acts, as well as systemic tensions and conflicts. The paper concludes by looking at broader questions that PIL generates for processes of civic participation, representative democracy and democratic polity under the constitution. (shrink)

Since January 2004, violent conflicts in the deep South of Thailand have caused 4,453 deaths, 7,239 injuries in 10,386 violent incidents. The numbers are increasing everyday. Myriads of studies, strategies and proposals have been put forth to address and redress this deep-rooted problem. This paper is a modest attempt to find analysis and inspiration from the rich cultural resources of Buddhism to address the question of conflict and conflict transformation in Thai society.The Buddhist “Genesis” or The Agganna-sutta has been analyzed (...) by Thai and Western Buddhist scholars as offering an allegorical tale which details a long, inter-dependent process of human beings’ moral degradation on the one hand, and socio-political evolution on the other. This is considered to be the Buddhist equivalent of the Genesis without God.This paper offers a re-reading of this important sutta as a narrative of conflict and conflict transformation. It argues that the personal conflict of the two young Brahmins aspiring to be fully ordained is transcended and transformed by the Buddha’s allegorical tale of human socio-political evolution. This paper offers an analysis of the narration and demonstrates that in the narrating process, the Buddha was “substituting” the Hindu creation myth with the Discourse on What is Primary (Agganna-sutta). This narrative replacement subverts the deep-rooted cultural force of the Hindu creation myth which serves as a cosmological justification for an hierarchy of classes/castes in the social world. Once the creation Hindu myth is de-mythologized, the structure of meaning for the personal conflict of the two Brahmins evaporates. In this way, the Buddha’s approach to conflict transformation addresses three dimensions simultaneously, namely, the personal, the socio-political and the cosmological.This re-reading is one paradigmatic example of how to revitalize Buddhism to function as an agent of social transformation by offering a Buddhist creative approach to conflict transformation. The paper examines three factors that are driving and constraining the development of rural legal services delivery in China: geographic limitation, professional interest and political intervention. Firstly, geography matters and rurality creates natural barriers for rural residents in limiting the access to legal services. There is an inherent spatial inequality for rural population when it comes to the distribution of legal service and the geographic isolation and remoteness nurture a particular type of legal culture among rural residents. Secondly, professionalism matters. (...) There are strong ideological and economic forces which pull the rural legal service providers away from their grass-roots. The calling of an emerging legal professionalism (and the related financial incentives) demands a certain degree of legal knowledge and qualification, rules of procedures, code of conduct and regularity in legal practice. In order to survive in an increasingly competitive legal market, rural legal service providers have to run legal practices as a business, considering the "bottom line" and following the logic of a legal market. Finally, politics matters. To overcome geographic barriers and correct market failure, the government would need to steps-in to provide or supplement legal service in rural areas by introducing a public dimension of legal services. Politics may ameliorate where the legal service market fails. (shrink)
